How to Get a Florida Divorce by Publication

This type of divorce is necessary when the whereabouts of the other party are not known.

A traditional divorce by publication takes approximately 12 weeks to complete from start to finish see the chart below:

Effective immediately we are decreasing the timeline above for a SIMPLE divorce by publication to approximately 6 weeks by having the final step (final hearing) waived (a no court divorce).

How much does a Divorce by Publication cost?

We keep our prices the same across the board:

Simple – $280.00

Divorce with Property – $320.00

Divorce with Children – $420.00

The court filing fee is $408.00 HOWEVER 80% of our clients do not pay the court filing fee or publication fee because they qualify for the Court filing fee waiver.

Step 1 – Information Necessary for Florida Divorce by Publication Process

Client Intake –   Clients complete one of the forms available on this page and submit it to our office. We will call the client to confirm the information and email an invoice.

Step 2 – Preparation of Divorce Forms

We will prepare the forms using the information provided.

The client then will review the forms and let us know if there should be any changes. If the client meets the income qualifications for a court filing fee waiver we complete this form as well.

At this point the forms can either be printed by the client or we will print them and mail them to the client.

Step 3 – Signing of the Divorce Forms

Signing – The forms must be signed in front of a notary, we can provide notary services at no charge in Tampa, Miami and Broward counties.

Step 4 – Filing the Divorce at the Courthouse

We will prepare and efile the divorce forms using the Florida court’s online portal. The court will request the publication.

Step 6 – Request for Divorce Court Hearing

Once the publication is received by our client they will submit it to us so that we can submit it to the court along with the request for hearing. Some counties allow to waive the final court hearing, we will let you know if this option is available.

Step 7 – Final Hearing

If your county requires a final hearing you will receive the hearing date in the mail. It is crucial that you attend this hearing. The hearing typically takes less than 5 minutes and you will be divorced at this time.

If the divorce is a simple divorce (no children or property) we will be able to skip the steps above, submit the final paperwork and the judge will review the case and sign it.

You will receive the final judgement in the mail without having to ever step in to the courthouse!

Divorces with children by publication will need to use the traditional method and a final hearing will be required.
